The BJs traffic study has been completed and the SEQRA is under review by the Smithtown Dept of Waterways and Environment. Environmental Conservation Law requires the sponsoring or
approving governmental body to identify and mitigate the significant environmental impacts of the activity it is proposing or permitting. However, the DEC has no authority to police the SEQRA
written by other agencies. Changes to traffic flow onto a state road- RT 25- from the shopping center must not impede traffic flow. The Ny DOT will review any traffic study privately done and can
conduct it's own study. An changes to driveways or turn lanes or lane's length must meet State codes . Any changes to ADA ramps must meet federal codes . Any new traffic lights are paid for by the developer.
A check for Covenants possibly issued at the the time the original shoppping center was built on that land can be undertaken.
A member of CCA explained how truck drivers have negotiated the entrances and exits of the shopping center to the truck bay for deliveries in past years.
